  1. Acceptance of Terms
    By accessing or using the stayFIZ website, mobile applications, or related services (collectively, the “Platform” or “Services”) provided by ZTOM SDN BHD (Company No. 202101014293 (1414593-V)) (“stayFIZ,” “we,” “us,” or “our”), you (“Tenant,” “you,” or “your”) agree to comply with and be bound by these Terms of Use (“Terms”). If you do not agree, you must not use the Services.
  2. Scope of Services
    •⁠  ⁠stayFIZ provides fully furnished, move-in-ready rooms in Penang’s Free Industrial Zone (FIZ), primarily for workers and students.
    •⁠  ⁠Services may include booking facilitation, lease agreements, in-person key handover, systemized rental payments, and monthly free cleaning.
    •⁠  ⁠stayFIZ is not a real estate agency; we rent and manage units directly under ZTOM SDN BHD.
  3. Tenant Responsibilities
    By using our Services, you agree to:
    •⁠  ⁠Provide accurate, up-to-date information when registering or entering agreements.
    •⁠  ⁠Pay rent and any applicable fees on time according to the terms in your tenancy agreement.
    •⁠  ⁠Maintain the rented room in good condition and use it responsibly.
    •⁠  ⁠Comply with stayFIZ community rules (e.g., no pets, no smoking, no drugs, no illegal activities, and maintaining cleanliness).
    •⁠  ⁠Respect other tenants and neighbors by avoiding disruptive or unlawful behavior.
  4. User Accounts
    •⁠  ⁠If you register an account on our Platform, you are responsible for safeguarding your login credentials.
    •⁠  ⁠You are responsible for all activities under your account. Notify us immediately of any unauthorized use or security issues.
  5. Termination of Tenancy / Access
    •⁠  ⁠stayFIZ reserves the right to terminate or suspend tenancy and/or access to the Platform if you breach these Terms, violate tenancy rules, or fail to pay rent.
    •⁠  ⁠Upon termination, you must vacate the premises as per your tenancy agreement, and your access to related services may be withdrawn.
  6. Intellectual Property
    •⁠  ⁠All materials on the stayFIZ Platform (design, text, images, logos, etc.) belong to stayFIZ or its licensors.
    •⁠  ⁠Tenants may not copy, modify, or distribute content without written permission.
  7. Disclaimers
    •⁠  ⁠The Services are provided “as is” and “as available.” While we strive for accuracy, we do not guarantee uninterrupted or error-free access.
    •⁠  ⁠stayFIZ is not liable for issues outside of its reasonable control (e.g., power outages, third-party service disruptions, force majeure).
  8. Limitation of Liability
    •⁠  ⁠To the fullest extent permitted by law, stayFIZ and its affiliates will not be liable for any indirect, incidental, or consequential losses (including but not limited to lost income, business interruption, or inconvenience).
    •⁠  ⁠Any direct liability arising from your use of the Services shall be limited to the total amount you have paid to stayFIZ for the specific Services giving rise to the claim.
  9. Indemnity
    You agree to indemnify stayFIZ and its affiliates from any claims, damages, or expenses arising from your breach of these Terms, misuse of the property, or unlawful conduct.
  10. Governing Law & Dispute Resolution
    •⁠  ⁠These Terms are governed by the laws of Malaysia, including the Personal Data Protection Act 2010 (PDPA).
    •⁠  ⁠Any dispute shall be referred to arbitration at the Asian International Arbitration Centre (AIAC), Kuala Lumpur, in English, before a single arbitrator. The decision is final and binding.
  11. General Provisions
    •⁠  ⁠Entire Agreement: These Terms and the signed tenancy agreement collectively govern your rental relationship with stayFIZ.
    •⁠  ⁠Modifications: We may update these Terms from time to time. Material changes will be communicated via email or on the website. Continued use means acceptance.
    •⁠  ⁠Severability: If one part of these Terms is invalid, the remaining provisions remain enforceable.
    •⁠  ⁠Notices: Official communications will be sent via email or notices on our website.
